The Lord Chancellor, in exercise of the powers conferred on him by sections 3 and 20 of the Legal Aid Act 1974(a), hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Legal Advice and Assistance (Prospective Cost) (No. 2) Regulations 1983 and shall come into operation on the day after the day on which they are approved by resolution of each House of Parliament 1983.

(2) The Legal Advice and Assistance (Prospective Cost) Regulations 1983(b), which were made on 24th October 1983 and laid on 1st November 1983 to come into operation 21st November 1983, are hereby revoked.

2. For the limit of £40 specified in section 3(2) of the Legal Aid Act 1974 there shall be substituted the limit of £50.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase from £40 to £50 the limit on the cost of legal advice and assistance under sections 1 and 2 of the Legal Aid Act 1974 which a solicitor may incur without obtaining the approval of the appropriate authority, revoking and replacing to the same effect the Legal Advice and Assistance (Prospective Cost) Regulations 1983.
