The Lord Chancellor, in exercise of the powers conferred on him by sections 1, 4 and 20 of the Legal Aid Act 1974(a), hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Legal Advice and Assistance (Financial Conditions) (No. 2) Regulations 1983 and shall come into operation on the day after the day on which they are approved by resolution of each House of Parliament 1983.

(2) In these Regulations, "the Act" means the Legal Aid Act 1974.

2. For the weekly sum of £99 specified in section 1(1)(a) of the Act, there shall be substituted the weekly sum of £103.

3. For the capital sum of £700 specified in section 1(1) of the Act, there shall be substituted the sum of £730.

4. For the weekly sum of £47 specified in section 4(2) of the Act, there shall be substituted the weekly sum of £49.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase the financial limits of eligibility for legal advice and assistance under Part 1 of the Legal Aid Act 1974.

The income limits are increased to make legal advice and assistance available to those with disposable incomes of not more than£103 a week and available without payment of a contribution to those with disposable incomes of £49 a week or less.

The capital limit is increased to make legal advice and assistance available to those with disposable capital of not more than£730.
