The Lord Chancellor, in exercise of the powers conferred on him by sections 1 and 20 of the Legal Aid Act 1974(a), hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Legal Advice and Assistance (Financial Conditions) (No. 2) Regulations 1979 and shall come into operation on 6th April 1979.

(2) In these Regulations unless the context otherwise requires, "the Act" means the Legal Aid Act 1974, "the 1978 Regulations" means the Legal Advice and Assistance (Financial Conditions) (No. 2) Regulations 1978(b), and other expressions have the same meaning as in the Act.

2. For the weekly sum of £52 specified in section 1(1)(a) of the Act, as amended by the 1978 Regulations, there shall be substituted the weekly sum of £75.

3. For the capital sum of £365 specified in section 1(1) of the Act, as amended by the 1978 Regulations, there shall be substituted the sum of £600.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase the disposable income limit for the availability of legal advice and assistance under the Legal Aid Act 1974 from £52 to £75 a week and increase the disposable capital limit from £365 to £600.
