2.Evolynsubmittedanapplicationundersection17oftheActfordirectionsinrelationto
TempleMillsInternationalDepot(TempleMills).InEvolyn’sletterdated5December
2024,itindicatedthat:
“ThepurposeofEvolyn’sapplicationisnot,atthispointintime,toseeka
directionrequiringEurostartoenterintoanaccesscontract….Ofcourse,a
directionrequiringEurostartoenterintoanaccesscontractmaybenecessaryin
thefullnessoftime,ifongoingnegotiationsfail.However,theprimarypurposeof
Evolyn’sapplicationatthisstageistoobtaininformationaboutthecapacityat
TMI(asa“railwayfacility”)fromEurostar(asthe“facilityowner”).
3.WealsonotethatatParagraph4ofEvolyn’sletterdated13December2024itreiterated
thispointandnotedthat:
“…thepurposeofitsapplicationatthisstageistoobtaininformationaboutthe
capacityatTMI.ItisforthisreasonthatEvolynhasnotprovidedacopyofthe
proposedTMIaccessagreementatthisjuncture”.
