IN THE COURTS OF KING'S BENCH AND COMMON PLEAS
[410] Adjourned Sittings in London. Guildhall, Dec. 3s 1829. levy v. pope, esq. sheriff of surrey (The attorney conducting a cause in Court may be called as a witness by the opposite side, and asked who employs him, in order to shew the real party, and so let in his declarations.) Case against the sheriff for omitting to execute a writ of fieri facias, by taking certain geods of the debtor within his bailiwick. The officer charged with the execution of the writ was one Denton, and on a difficulty occurring in proving this as against the sheriff ; the Attorney-General, in order to prove Demton to be the real defendant, called the attorney who conducted tha defence, and asked him who employed him to defend the cause.
