The Local Authorities (Goods and Services) (Public Bodies) (Scotland) Order 1978

In exercise of the powers conferred upon me by section 1(5) of the Local Authorities (Goods and Services) Act 1970(a), and of all other powers enabling me in that behalf, I hereby make the following order:—

Citation and commencement

1. This order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (Scotland) Order 1978 and shall come into operation on 5th January 1979.

Interpretation

2.—(1) The Interpretation Act 1889(b) shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

(2) References in this order to the provisions of any enactment shall be construed as references to those provisions as amended by any subsequent enactment.

Designation of public bodies

3. The persons and descriptions of persons specified in the Schedule to this order, being persons and descriptions of persons appearing to me to be exercising functions of a public nature, shall be public bodies for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to Scotland.

SCHEDULE

PUBLIC BODIES

The Scottish Special Housing Association.

A New Town Development Corporation.

A Housing Association registered under Part II of the Housing Act 1974(a).

The Highlands and Islands Development Board.

The Convention of Scottish Local Authorities.

A Health Board.

The Management Committee of the State Hospital, Carstairs.

The Common Services Agency for the Scottish Health Service.

A Voluntary Hospital having a contractual arrangement with a Health Board.

A Scottish University.

The Governors of a residential college of adult education.

An association approved by the Secretary of State under Regulation 8 of the Further Education (Scotland) Regulations 1959(b).

The Managers, Governors or other Body responsible for the management of a central institution or college of education as defined in the Education (Scotland) Act 1962(c).

The Managers of a residential special school or orphanage within the meaning of Regulation 1(1)(i) and Regulation 1(1)(g) of the Residential Special Schools and Orphanages (Scotland) Grant Regulations, 1948(d).
