The Local Government Act 1985 (Police and Fire and Civil Defence Authorities) Precepts Limitation Order 1988

Made 9th February 1988

Coming into force 14th February 1988

Whereas by virtue of section 68(6) of the Local Government Act 19851the authorities listed in the Schedule to this Order are deemed for the purposes of Part I of the Rates Act 19842(selective limitation of rates and precepts) to have been designated under section 2 of the said Act of 1984 in relation to the financial year beginning on 1st April 1988;

And whereas notice has been served by me on each of those authorities pursuant to section 4(1) of the said Act of 1984 stating the maximum which I propose to prescribe under section 1 of that Act for the precept issued by it for that year;

And whereas none of those authorities has accepted the maximum proposed by me within the period specified in the notice, or agreed with me a different maximum;

And whereas a draft of this Order has been approved by resolution of the House of Commons;

Now, therefore, I, in exercise of the powers conferred on me by sections 1 and 4(4) of the Rates Act 1984, as applied by section 68(4) of the Local Government Act 1985, hereby make the following Order:

S-1 This Order may be cited as the Local Government Act 1985...

1. This Order may be cited as the Local Government Act 1985 (Police and Fire and Civil Defence Authorites) Precepts Limitation Order 1988 and shall come into force on 14th February 1988.

S-2 There is hereby prescribed, under section 1 of the Rates Act...

2. There is hereby prescribed, under section 1 of the Rates Act 1984, as applied by section 68(4) of the Local Government Act 1985, as the maximum amount in the pound for the precept issued for the financial year beginning on 1st April 1988 by an authority listed in the Schedule to this Order, the amount there set against the name of the authority.
