The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 19881, and of all other powers enabling him in that behalf, hereby makes the following Order:

1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Tamworth Borough Council) Order 1992 and shall come into force on1st October 1992.

2. The Local Government Act 1988 (Defined Activities) (Exemptions) (England)(No. 3) Order 19912is amended by the substitution, in the Table in article 3, of “1st August 1993” for “1st October 1992.”

Under Part I of the Local Government Act 1988 (Competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.

The Local Government Act 1988 (Defined Activities) (Exemptions) (England) (No. 3) Order 1991 exempts from the requirements of Part I the management of sports and leisure facilities by Tamworth Borough Council, so long as such work is undertaken at Tamworth Castle Swimming Pool, the Pleasure Grounds, Tamworth, before 1st October 1992. This order substitutes 1st August 1993 for that date.
