An Act to confirm certain Provisional Orders of the Local Government Board relating to the Rural Sanitary District of the Abergavenny Union, the Improvement Act District of Bradford (Wilts), the Local Government District of Brigg, the Boroughs of Brighton and Cheltenham, the Local Government District of Ebbw Vale, the Improvement Act District of Leek, the Boroughs of Liverpool and Preston, the Local Government District of St. Columb, the Borough of Tiverton (two), the Local Government District of Tredegar, and the Special Drainage District of Washington.

An Act to confirm certain Provisional Orders of the Local a.d. 1878. Government Board relating to the Rural Sanitary District of the Abergavenny Union, the Improvement Act District of Bradford (Wilts), the Local Government District of Brigg, the Boroughs of Brighton and Cheltenham, the Local Government District of Ebbw Vale, the Improvement Act District of Leek, the Boroughs of Liverpool and Preston, the Local Government District of St. Columb, the Borough of Tiverton (two), the Local Government District of Tredegar, and the Special Drainage District of Washington. [22d July 1878.] W HEREAS the Local Government Board have, as regards the districts herein mentioned, made the Provisional Orders set forth in the schedule hereunto annexed, under the provisions of the Public Health Act, 1875: . Sf^i?Vict" And whereas it is requisite that the said Orders should be confirmed by Parliament, and that the provisions herein contained should be enacted in reference to certain of the said Provisional Orders: Be it therefore enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows : 1. [Local.-/64.] A 1 [Ch, QlxiV.] Local Government Board's Provisional [41 & 42 Vict.] Orders Confirmation, {Abergavenny Union, fyc.) Act, 1878. A.D. 1878. in. Lower Rock Gardens " have been formed and made, and have been declared to be a highway under the provisions of section one 38 & 39 Vict, hundred and fifty-two of the Public Health Act, 1875, it shall be lawful for the Urban Sanitary Authority by a resolution, a copy of which shall be put up at each end of Lower Rock Gardens, to declare that the present roads and footpaths situate on the east and west sides of Lower Rock Gardens, or such parts thereof as do not form part of the new road and footpaths, shall, after the expiration of seven days from such copy being so put up, be closed, and after the expiration of the said seven days the Urban Sanitary Authority shall, at their own expense, convert the whole or such part of the site of the present roads and footpaths into areas ov forecourts to the bouses in Lower Rock Gardens aforesaid, according to the respective widths or frontages of such houses, and such areas or forecourts shall thence forth vest in and become the property of the respective owners, lessees, and occupiers of such houses, according to their respective estates or interests in such houses, in exchange for the rights of such owners, lessees, and occupiers respectively in the present roads and footpaths, and in the lawn or enclosure aforesaid. Special pro- 3 jf the Urban Sanitary Authority for the borough of Liverpool the borough shall put in force the powers of the Lands Clauses Consolidation of Liverpool. Acts, 1845, 1860, and 1869, or any of them, conferred upon them 8 & 9 Vict, by the Provisional Order relating to that borough, and hereby con- c 18. firmed, with reference to the lands required for the widening of 23 & 24 Vict. o c. 106. Brythen Street, and numbered 310 in the schedule to such Pro- 32&,3,3Vict. visional Orders, and on the deposited plans therein referred to, which are vested in Joseph Walmsley and others, or any part thereof, the said Urban Sanitary Authority shall (if required by or on behalf of the said Joseph Walmsley and others) take the whole of the adjoining lands vested in the said Joseph Walmsley and others situate between Williamson Square and Charles Street, together with the Theatre Royal and buildings thereon; and the powers and provisions conferred by the said Provisional Order with respect to the purchase and taking of lands shall extend and apply to such adjoining lands and to the said Theatre Royal and buildings. Further pro- 4. When and so soon as Stanley Street, in the borough of borou h$ *f 3JiTerPl' snaH have oeen widened, and the proposed new street in Liverpool, continuation of Stanley Street from Victoria Street to Whitechapel shall have been respectively completed by the Urban Sanitary Authority of the said borough under the powers of the Provisional Order relating to that borough, and hereby confirmed, and such new street ?2 [41 & 42 Vict.] Local (Government Board's Provisional [Oh. clxiv.] Orders Confirmation {Abergavenny Union, 8fc.) Act, 1878. shall have been declared to have been a highway repairable by the A-D-18?8- inhabitants at large, it shall he lawful for the Urban Sanitary Autho- rity, by a resolution or resolutions, a copy of which shall be put up at each end of Stanley Street and also at each end of such new street respectively, to declare that after the expiration of seven days from such copy being so put up the streets .called Poplar Lane, and also Bakehouse Lane from Stanlev Street to Cumberland Street, and the parts of Stanley Street not forming part of the said new street, and the parts of Brokers Alley, Matthew Street, and Derby Street, as the case may be, respectively shown upon the deposited plan referred to in the said Order as intended to be closed shall be closed; and after the expiration of the said seven days the said streets and parts of streets shall be closed accordingly, and all rights of way over the same respectively shall thereupon be absolutely extinguished: Provided that the closing of the said streets and parts of streets respectively shall not take place until the interests of all parties (except the Earl of Derby) in the lands shown upon the deposited plan abutting upon both sides of the said streets and parts of streets respectively proposed to be closed, or in the lands shown upon the said deposited plan with which the said streets or parts of streets respectively form the means of communication, shall have been respectively acquired, surrendered, or determined. 5. In constructing, using, and maintaining the new street from Special pro- Mshergate Hill to Marsh Lane, in the borough of Preston, men- J,181?11 as * . the borough tioned m the Provisional Order relating to that borough hereby of Preston. confirmed, the Urban Sanitary Authority of that borough shall not, without the written consent of the London and North Western Railway Company and the Lancashire and Yorkshire Railway Company, the proprietors of the North Union Railway, and of the Ribble Navigation Company, alter, interfere with, or damage the tunnel or works of the Ribble Branch Railway, and the Urban Sanitary Authority shall only be empowered to acquire from the said Companies an easement for the construction, use, and maintenance of a public road or street over the top of the said tunnel, and not the power to take the said tunnel or works or any part thereof. 6. When the Provisional Order hereby confirmed, whereby the Special pro- Local Government District of Saint Columb is dissolved, comes into P8-10^t0 ' hamt Co- operation, so much only of the powers, rights, duties, capacities, lumb Local liabilities, obhgations, and property exerciseable by, or attaching Goverment to, or vested in the Saint Columb Local Board, as are exerciseable A 2 3 [Ch. A.D. 1878. by, or attach to, or are vested in a Rural Sanitary Authority under 38&"39Viet. the Public Health Act, 1875, shall be transferred to the Guardians c- 55- of the Poor of the Saint Oolumb Major Union, as the Sanitary Authority for the rural sanitary district of that union. RURAL SANITARY DISTRICT OE THE ABERGAVENNY Aberga- UNION. venZZkm provisional Order to enable the Sanitary Authority for the Rural Sanitary District of the Abergavenny Union to put in force the Compulsory Clauses of the Lands Clauses Consolidation Acts, 1845, 1860, and 1869. To the Guardians of the Poor of the Abergavenny Union, in the Counties of Monmouth and Hereford, being the Sanitary Authority for the Rural Sanitary District of that Union ; And to all others whom it may concern. WHEREAS the Guardians of the Poor of the Abergavenny Union, in the Counties of Monmouth and Hereford, as the Sanitary Authority for the Rural Sanitary District of that Union, require to purchase and take the lands which are described in the Schedule hereto for the disposal of the sewage of the part of the Parish of Llanfoist, in the County of Monmouth, which is comprised in the said Rural Sanitary...
