The Local Government Reorganisation (Wales) (Consequential Amendments) Order 1995

The Secretary of State for Wales, in exercise of the powers conferred on him by sections 54(1) and (2)(e) and 63(5)(a) of the Local Government (Wales) Act 19941and of all other powers enabling him in that behalf, hereby makes the following Order:—

S-1 This Order may be cited as the Local Government Reorganisation...

1. This Order may be cited as the Local Government Reorganisation (Wales) (Consequential Amendments) Order 1995 and shall come into force on 17th February 1995.

S-2 In this Order, “the 1988 Act ” means the Local Government Act...

2. In this Order, “the 1988 Act” means the Local Government Act 19882.

S-3 In subsection (2) of section 1 of the 1988 Act (meaning of...

3. In subsection (2) of section 1 of the 1988 Act (meaning of “local authority”), omit “and Wales” and (in paragraph (a)) “a community council”, and after that subsection insert—

S-2A

“2A In the application of this Part to Wales, “local authority” in subsection (1) above means a county council, a county borough council or a community council.”.

S-4 In relation to any work carried out or proposed to be carried...

4. In relation to any work carried out or proposed to be carried out at any time before 1st April 1996, section 1(2A) of the 1988 Act (as inserted by article 3 above) shall have effect as if for the words “county borough” there were substituted the word “district”.

Section 1 of the Local Government Act 1988 specifies certain “defined authorities” for the purpose of Part I of that Act (Competition). A “local authority” is classed as a defined authority, and for England and Wales the definition of “local authority” is in Section 1(2). This Order amends that definition to include the new authorities to be established in Wales in consequence of the Local Government (Wales) Act 1994. The status of the existing authorities which will remain in existence until 1st April 1996, as defined authorities, is preserved by article 4.
