Approval of the 51st supplemental agreement to the track access contract
between Network Rail Infrastructure Limited (Network Rail) and London North
Eastern Railway Limited (trading as LNER) dated 3 March 2017
We have today approved the above supplemental agreement submitted to us
formally on 2 April under section 22 of the Railways Act 1993 (the Act). This follows
an earlier informal submission of a draft agreement for our consideration. This letter
explains the reasons for our decision.
Purpose
The purpose of this agreement is to extend LNER’s currently-held contingent rights
for the following services:
• 1 x weekday service from Darlington to Newcastle; and
• 1 x Saturday services from Newcastle to Darlington.
Both rights currently due to expire on the Subsidiary Change Date (SCD) in May
2026 and this supplemental agreement will extend them for one further timetable
period to the Principal Change Date (PCD) in December 2026.
Industry consultation
Network Rail undertook the usual industry consultation for 1 month from 12
February. Comments in support or stating no objection were received from Transport
Focus, Northern Trains, CrossCountry, Great Western Railway and West Yorkshire
Combined Authority.
ORR review
Our review of the application raised no operational, performance or economic
concerns, nor did we identify any drafting issues.
