MEANING
OF
"HOUSEHOLD".
Suffolk County Council v. S
Baby S was born on
4th
January 1980 in a local hospital.
It
stayed in
the hospital until 25th January, 1980 when the local authority sought a
place
of
safety order on the grounds
that:-
"It
was probable that, having regard to the fact that the Court or
another Court has found that the same condition is or was satisfied
in the case
of
another child or young person who is or was a member
of
the household to which she belongs her proper development is
being avoidably prevented or neglected or her health is being avoidably
impaired or neglected or she is being ill-treated".
The application was made because the mother wished to remove the
child from the hospital to her home.
Section 28(1) Children and Young Persons Act 1969 states that
"If
upon application to a Justice by any person for authority to
detain a child or young person and take him to a place
of
safety,
the Justice is satisfied that the applicant has reasonable cause to
believe
that:-
(a) Any
of
the conditions set out in Section 1(2) (a) to (e)
of
this
Act is satisfied in respect of the child or young person; or
(b) An appropriate Court would find the condition set out in
Section 1 (2) (b)
of
this Act satisfied in respect
of
him; or
(c) .
the Justices may grant the application".
