Margaret Rivets Case

margaret rivets cash. Un Judgment in debt fuit done versus Margaret Rivet Administratrix durante minori setate de sa fits; Et in Scire facias port versus luy, il plead in barr, que el fuit Administratrix, &c. Et que sa fits tiel jour deveigne al son age de 17 anus, & que apres il refuse devant le Ordinary ; & que administracon fuit grant al estranger, & que el avoit deliver tout les biena unadministred a luy; & que el navoit ascun biens in ses maines al temps del breve port ou puis, &c. Le plaintiff replie & confesse tout le barr; mea que ante le delivery des bieus & administracon graut per la Ordinary, devastavit: Et ne dit predict' Margaret devastavit. Le Defendant joyn issue, quod predict' Margaret non devastavit, que fuit trove pur le Defendant. Et Hitchara move in arrest de Judgment, pur ceo que fuit nul issue : car chescun issue doet ee certein, & le issue grow sur le affirmative; donque le parol del Defendant quod predict', &c. fuit riens. Car le affirmative fait le issue. Come Couutee de Salops Case; Ou question est, Barr poet ee prise sur common intent: mes replication doet ee precise & certein. In le Exchequer Chamber Sir Thomas Harris Case, un plead que fuit aeisie de Whiteaere, & Feoffavit, &c. & adjudge male. Et uncore la fuit mesme plea; car doet ee feoffavit inde: car poet ee seisie de Whiteaere & infeoff de auter acre. Et issint icy poet ee dit que auter devastavit, coment que la feme fuit administratrix. Athowe. Observe tout le course del Record, & poet refer al Margaret. Car il confess touts les Circumstances del Barr, Et devastavit, que poet degaster, raes le Administratrix ? & utrumque poet ee amend ; car est default del Clark, & est cy necessary intendment que ne poet refer al auter. Crooke. Nest parol in le Replicacon de Margaret mes solement in le recital: raes dit inte diem quo, &c. devastavit, Et le Replication ne poet ee prise par intendment, que ne poet ee amend ; car nest vitium scriptoria, nest cy mult come ipsa [63] devastavit: mes sil avoit dire que predict' Margaret avoit biens in ses maines 6 December & devastavit, donque serroit bon.
