Case Number: 2300366/2020
THE EMPLOYMENT TRIBUNAL
BETWEEN:
Mr J Ross
Claimant
and
American Express Services Europe Limited
Respondent
JUDGMENT
1. The claims of disability and sexual orientation discrimination have been
struck out pursuant to non-compliance by the claimant with an Unless Order.
2. The claim for unpaid wages is struck out as having no reasonable prospect
of success.
REASONS
1. Further to the Unless Order made by Employment Judge Britton on 16 February
2021 and sent to the parties on 5 March 2021, the claim of disability discrimination
has been struck out in its entirety for non-compliance with the Order at paragraph
1 of the case management orders.
2. The claimant did pay the deposit ordered at paragraph 3 of those same case
management orders within the time limit. However, he did not comply with the
Unless Order at paragraph 5 to provide full particulars of his sexual orientation
claim within 21 days thereafter, and therefore that claim has also been struck out
in its entirety.
3. Further, the claimant did not comply with paragraph 6 of the same case
management orders in repsect of his wages claim. Accordingly that claim is also
struck out as having no reasonable prospects of success.
