Navigation Act, 1847, certain previous Acts relating to the
c.

harbour
of
Newhaven in the county
of
Sussex, and
the
improve-
ment
of
the navig,ation of the River Ouse between Newhaven Bridge
and Lewes Bridgc, and the draining
of
the low lands lying in Lemes
and Laughton Levels in the said county, were repealed, and trustees
were
noniinated under the name
of
"
The Trustees of Kcwhaven
Harbour and Ouse Lower Navigation," and were incorporated
for
the purpose of carrying the said Act into effect
:
And whereas by the 49th section
of
the said Act
of
1847 the
said trustces
ak
required
to
maintain and support the said harbour
of
Newhaven, and the piers, groynes, sluices, wharves, mooring-
berths, and other works connected therewith, and
also
to maintain
the open navigation
of
the River
Ousc
between Newhaven Bridge
and Lewcs Bridgc
for
vessels drawing four feet
of
water at common
neap tides to pass along the same
;
and also
to
execute such other
works, not extending beyond the banks
or
walls
of
the said river,
beside the works defined in the said section,
as
may, in the judgment
of
the trustees, be necessary or proper for the better draining of the
low
lands lying in Lewes
and
Laughton Levels
;
and the said Act
confers on the trustees powers for executing the works, and enables
them to levy certain harbour dues in respect
of
all vessels which
shall enter the said harbour
of
Newhaven, and in respect of all
goods which shall be discharged
or
shipped in the said harbour, and
(with certain exceptions) in respect
of
all
goods wliich shall pass up
or down any part
of
the River
Ouse
between NewhaTTen Bridge and
Lewes Bridge
;
but the said duties were varied by the Newhaven

struct
a
new cut
in
the River Ouse, and a new road and tramway
in coiinexion with the Newhaven Town Station
of
the London,
Brighton, and South Coast Railway Company (herein-after called
‘‘
the Brighton Railway Company
”),
and also
a
new bridge over the
River ‘Ouse
:
And whereas the trustees borrowed from the Public Works
Loan
Commissioners, by way of mortgage upon the security
o€
the harbour
dues, Scots and other revenue and property
of
the trustees, a sum
of
money repayable by annual instalments, with interest, and there
was on the 21st February
1878
due under such mortgage
a
balance
of $32,475 for principal money, with some interest thereon
:
And whereas the harbour
of
Newhaven is inadequate
to
the
accommodation of its commerce, whicb has of late years largely
increased, and is increasing, mainly by means of the traffic between
the undertaking of the Brighton Railway Company and Dieppe,
and
it
is expedient that the works herein-after described should be
executed for the enlargement and improvement
of
the harbour, and
that in order to construct and maintain the harbour works the
tramway herein-after described should be authorised, but that
no
tolls or other charges shall be taken in respect of the use thereof:
And whereas
it
is also expedient that the Brighton Railway
Com-
pany should be authorised to contribute towards the expense
of
the
said works, and
to
guarantee interest
or
dividends upon the capital,
or
part of the capital,
to
be raised under the powers of this Act, and
to
take part in the management of the harbour, and that the arrange-
ments herein-after defined should be made with the said trustees
:
And whereas the persons herein-after named, with others, are
willing
at
their own expense to execute the powers
of
this Act
on
being incorporated into
a
Company
;
and the trustees have concurred
in the provisions of this Act
:
And whereas plans describing the lines and situation of the
works authorised by this Act, and the lands, houses, and other pro-
perty which may be taken under the powers of this Act, and sections
describing the levels
of
the said intended works, together with
a
book
of reference to the said plans containing the names
of
the owners
or
reputed owners, lessees
or
reputed lessees, and of the occupiers
of
the
said lands, houses, and other property, have been deposited with the
clerk of the peace for the county of Sussex, and are herein-after
referred to
as
the deposited plans, sections, and book
of
reference:
And whereas the purposes
of
this Act cannot be effected without
the authority of Parliament
:
May
it
therefore please Your Majesty that
it
may be enacted;
and be
it
enacted by the Queen’s most Excellent Majesty, by and
with the advice
and
consent
of
the Lords Spiritnal and Temporal,
