Approval and Directions for Novation of the Connection Contract at Jarrow oil
terminal sidings dated 5 September 2022
Pursuant to sections 18 and 22 of the Railways Act 1993, I direct and approve (as
appropriate) the entry into the deed of novation of the connection contract above,
currently between Tyne and Wear Passenger Transport Executive and Prax
Terminals Jarrow Limited in the form submitted to ORR on 5 June 2026.
Accordingly, I direct Tyne and Wear Passenger Transport Executive and Phillips 66
Limited to enter into the proposed access contract with each other on the terms
agreed no later than 16 September 2026.
You shall be released from the duty to enter into the contract in question if either of
you fails to enter into the proposed access contract, by the date which is no later than
16 September 2026.
The amendments approved and directed upon are amendments which have the effect
set out in the attached deed of novation.
