This statutory review of a New South Wales scheme for considering applications
from offenders relating to DNA evidence recommends the scheme’s abolition on
the basis that the continuing need for post-conviction review based on DNA
evidence can be dealt with through other general post-review mechanisms, in
tandem with streamlining and the retention of provisions for preserving
biological exhibits and providing access to DNA testing. The Review’s recommen-
dations were implemented in late November through the enactment of the
Crimes (Appeal and Review) Amendment (DNA Review Panel) Act 2013 (NSW).

This Consultation Paper is part of an ongoing government review of reforms to
homicide defences introduced in 2005 following an inquiry by the Victorian Law
Reform Commission. Although primarily concerned with the substantive law, the
review also considered evidence law reforms aimed at protecting the reputation
and dignity of homicide victims. The Consultation Paper rejects an extension of
sexual history evidence provisions to homicide victims that was canvassed in a
2010 Issues Paper, but proposes two new evidence law reforms: modifying an

existing provision regulating improper cross-examinations so that it applies to all
questioning about a homicide victim; and adapting a provision on the accused’s
character so that prosecutors may rebut defence evidence attacking a homicide
victim’s character without complying with the hearsay, opinion, tendency or
credibility rules.

This Report is a follow-up to an initial report on jury directions in 2012, which was
implemented in the Jury Directions Act 2013 (Vic). The new report recommends
refinements of the existing Act’s provision on the ‘residual’ requirement to give
jury directions that were not requested by a party as well as new provisions
concerning directions that particular facts must be proven beyond reasonable
doubt, other misconduct
