OFFICIAL SECRETS

The Official Secrets Act 1989 (Prescription) Order 1990

Made 9th February 1990

Coming into force 1st March 1990

In exercise of the powers conferred on me by sections 7(5), 8(9),12 and 13(1) of the Official Secrets Act 19891, a draft of this instrument having been laid before Parliament and having been approved by each House of Parliament, I hereby make the following Order:

S-1 This Order may be cited as the Official Secrets Act 1989...

1. This Order may be cited as the Official Secrets Act 1989 (Prescription) Order 1990 and shall come into force on the day appointed for the coming into force of the Official Secrets Act 1989 (hereinafter referred to as “the Act”).

S-2 The bodies which are set out in the first column of Schedule 1...

2. The bodies which are set out in the first column of Schedule 1 to this Order and the classes of members or employees of those bodies which are set out in the second column of that Schedule are hereby prescribed for the purposes of section 12(1)(f) of the Act (definition of “Crown servant”).

S-3 The offices which are set out in the first column of Schedule 2...

3. The offices which are set out in the first column of Schedule 2 to this Order and the classes of employees of the holders of those offices which are set out in the second column of that Schedule are hereby prescribed for the purposes of section 12(1)(g) of the Act (definition of “Crown servant”).

S-4 The bodies which are set out in the first column of Schedule 3...

4. The bodies which are set out in the first column of Schedule 3 to this Order are hereby prescribed for the purposes of one or both of sections 7(5) and 8(9) of the Act as set out in the second column of that Schedule (so as to enable them, in the case of section 7(5), to give official authorisation for, or to impose official restrictions on, disclosures or, in the case of section 8(9), to give official directions for the return or disposal of documents).
