Introduction
[1] The petitioner is the General Medical Council (“GMC”). The respondent is a medical
practitioner who is registered with the GMC. The GMC has responsibility for keeping a
register of medical practitioners and for supervision and regulation of their fitness to
practise. The petitioner seeks an order in terms of section 41A(7) of the Medical Act 1983
(“the 1983 Act”) extending an interim order made by its Interim Orders Tribunal (“IOT”).
[2] The respondent is the subject of a fitness to practise investigation, initiated after
Police Scotland deemed him to be unsuitable to work with children or vulnerable adults and
he was charged with a contravention of section 52A(1) of the Civic Government (Scotland)
Act 1982, that is possession of indecent images of children. The respondent referred himself
