PHYSICAL TRAINING AND RECREATION, SCOTLAND
THE PHYSICAL TRAINING AND RECREATION ACT (FORMS OF COMPULSORY PURCHASE ORDER AND NOTICES) REGULA-TIONS (SCOTLAND), 1938, DATED DECEMBER 19, 1938, MADE BY THE DEPARTMENT OF HEALTH FOR SCOTLAND UNDER THE PHYSICAL TRAINING AND RECREATION ACT, 1937 (1 EDW. 8 & 1 GEO. 6. C. 46).The Department of Health for Scotland in exercise of the powers conferred upon them by the Physical Training and Recreation Act, 1937, and of all other powers enabling them in that behalf hereby make the following Regulations:—
1.—(1) These Regulations may be cited as the Physical Training and Recreation Act (Forms of Compulsory Purchase Order and Notices) Regulations (Scotland), 1938.
(2) The Interpretation Act, 1889, applies to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.
2. The forms set out in the Schedule to the Regulations, or forms substantially to the like effect, shall be the forms to be used by a Local Authority in Scotland in connection with the compulsory purchase of land for the purposes of subsection (1) of section 4 of the Physical Training and Recreation Act, 1937, in the cases to which those forms are applicable.

Form of Compulsory Purchase Order
The Physical Training and Recreation Act, 1937
In pursuance of the powers vested in them by the Physical Training and Recreation Act, 1937, the (name of Local Authority making the Order) (in this Order referred to as the "Local Authority") hereby make the following Order:—
1. Subject to the provisions of this Order the Local Authority are hereby authorised to purchase compulsorily for the purpose of (state the purpose for which the lands are required) the lands described in the Schedule hereto, which lands are coloured on a Map marked and signed and sealed with reference to this Order and deposited at the offices of the Local Authority.
2. The Lands Clauses Acts (except Sections 90 and 120 to 125 of the Lands Clauses Consolidation (Scotland) Act, 1845), as modified by subparagraphs (i) and (ii) of paragraph 3 of Part 1 of the Third Schedule to the Town and Country Planning (Scotland) Act, 1932, the Acquisition of Land (Assessment of Compensation) Act, 1919, as modified as aforesaid, and Sections 70 to 78 of the Railways Clauses Consolidation (Scotland) Act, 1845, are, subject to the necessary adaptations, hereby incorporated in this Order, and...
