The Plant Health (Great Britain) (Amendment) (No. 3) Order 1996

Coming into force 1st January 1997
The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred on them by sections 2 and 3 of the Plant Health Act 19671and now vested in them2and of all other powers enabling them in that behalf, hereby make the following Order:
Title and commencement
1. This Order may be cited as the Plant Health (Great Britain) (Amendment) (No. 3) Order 1996 and shall come into force on 1st January 1997.
Amendment of the Plant Health (Great Britain) Order 1993
2. The Plant Health (Great Britain) Order 19933shall be amended in accordance with the provisions of articles 3 to 6 below.
3. In Schedule 1, Part A, Section 1(c), after item 15 there shall be inserted the following—
“15.1Tilletia indica Mitra.”
4. In Schedule 4, Part A, Section 1, after item 52 there shall be inserted the following—
“53 Seeds of the generaTriticum, Secale and X Triticosecale from Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA where Tilletia indica Mitra is known to occur. |
Official statement that the seeds originate in an area where Tilletia indica Mitra is known not to occur. The name of the area shall be mentioned on the phytosanitary certificate. |

Official statement that either: (i) the grain originates in an area whereTilletia indica Mitra is known not to occur, the name of the area or areas being mentioned on the phytosanitary certificate under the rubric “place of origin””, or (ii) no symptoms ofTilletia indica Mitra have been observed on the plants at the place of production during their last complete cycle of vegetation and representative samples of the grain have been taken both at the time of harvest and before shipment and have been tested and found free from Tilletia indica Mitra in these tests, the latter shall be mentioned on... |
