The Pneumoconiosis etc. (Workers' Compensation) (Specified Diseases) Order 1985

Coming into Operation 1st January 1986

The Secretary of State in exercise of the powers conferred on him by section 1 of the Pneumoconiosis etc. (Workers' Compensation) Act 1979 (“the 1979 Act”), as amended by section 24 of the Social Security Act 1985, and of all other powers enabling him in that behalf hereby makes the following Order, of which a draft has been approved by resolution of each House of Parliament:—

1. This Order may be cited as the Pneumoconiosis etc. (Workers' Compensation) (Specified Diseases) Order 1985 and shall come into operation on 1st January 1986.

S-2 Specified Diseases

Specified Diseases

2. The following diseases are specified for the purposes of the 1979 Act:—

(a) primary carcinoma of the lung where there is accompanying evidence of one or both of the following:—

(i) asbestosis

(ii) bilateral diffuse pleural thickening;

(b) bilateral diffuse pleural thickening.

EXPLANATORY NOTE

The Pneumoconiosis etc. (Workers' Compensation) Act 1979 provides for lump sum compensation to be paid by the Secretary of State to persons disabled by a disease to which the Act applies or to dependants of persons who immediately before they died were disabled by such a disease. The diseases covered by the Act are pneumoconiosis, byssinosis, diffuse mesothelioma and such other diseases as are specified by the Secretary of State. This Order, which comes into operation on 1st January 1986, specifies the following additional diseases:—

(a) primary carcinoma of the lung where there is accompanying evidence of one or both of the following:—

(i) asbestosis

(ii) bilateral diffuse pleural thickening;

(b) bilateral diffuse pleural thickening.
