CHAPTER xxxviii.
An Act to empower the Port of London Authority
A.D.
1932.
to acquire lands and to borrow further moneys
and for other purposes. [16th June 1932.]
W
HEREAS by the Port of London Act 1908 the
Port of London Authority (hereinafter referred
to as " the Port Authority ") were established for the
purpose of administering preserving and improving the
Port of London and for other purposes in that Act set
forth and by such Act (inter alia) the undertaking and
powers of the London and India Docks Company and
other undertakings and powers were transferred to
and vested in the Port Authority and other provisions
were made and other powers were conferred upon the
Port Authority:
And whereas by various subsequent Acts and
Orders further powers were conferred upon the Port
Authority and the Port Authority have executed divers
works for the improvement of the Port of London :
And whereas by the Port of London (Consolidation)
Act 1920 (hereinafter referred to as " the Act of 1920 ")
the provisions of the various statutes by which or by
reference to which the constitution powers rights
authorities privileges duties and obligations of the Port
Authority were then defined were amplified consolidated
and amended as in that Act appearing:
And whereas by section 243 of the Act of 1920
the Port Authority may as therein mentioned grant

1932. to any owner or occupier of any land adjoining the
river Thames a licence for making various works therein
described immediately in front of his land and into the
body of the river Thames and for doing various other
works affecting the said river as in the said section
mentioned:
And whereas under and by virtue of the Act 32
George III chapter 31 entitled " An Act for more
" effectually embanking draining and otherwise improving
" the Island of Canvey in the County of Essex " (herein-
after called " the Act of 1792 ") a body of commissioners
(hereinafter called " the old commissioners ") was con-
stituted for the execution of that Act and a wall or
embankment (hereinafter called " the old wall") and
certain other works which before the passing of the Act
of 1792 had been raised round the said island of Canvey
for the protection of the said island from inundation by
the sea were vested in the old commissioners and they
were entrusted with the duty of maintaining the works
so vested in them and of executing and maintaining such
other works as should be necessary for the protection and
drainage of the said island :
And whereas in or about the year one thousand
eight hundred and thirteen a portion of the old wall on
the south side of the island extending from about
Holehaven Point to Scar's Elbow had fallen into serious
disrepair and in or about the year one thousand eight
hundred and fourteen the old commissioners constructed
a new wall or bank and a roadway or cart track and a
ditch or channel inside the same and wrorks in connection
therewith (which said new wall or bank roadway or cart
track ditch or channel and works are hereinafter called
" the existing river wall "):
And whereas the existing river wall was constructed
on the landward side and for the most part at some
considerable distance from the said portion of the old
wall which was formerly between the points aforesaid :
And whereas by the Canvey Island (Sea Defences)
Act 1883 (hereinafter called "the Act of 1883") the
old commissioners ceased to hold office and a body of
fifteen commissioners was constituted as a body corporate
by the name of the Canvey Island Commissioners
(hereinafter called "the commissioners ") with perpetual

succession and a common seal and all property real and -A.D. 1932.
personal vested in or belonging to the old commissioners
and all powers rights duties capacities liabilities and
obligations exerciseable by or attaching to the old
commissioners under the Act of 1792 or otherwise were
subject to the provisions of the Act of 1883 transferred
to and vested in and made exerciseable by or attached
to the commissioners :
And whereas under and by virtue of the Act of 1920
the bed and shore of the river Thames westward of an
imaginary line drawn from Yantlet Creek to the City
Stone opposite to Canvey Island are with certain minor
exceptions vested in the Port Authority in fee simple :
And whereas the old wall has as to a considerable
portion thereof been destroyed and the site thereof
is now part of the bed of the river Thames :
And whereas the Port Authority are the owners
of lands lying on the north side of the existing river
wall including the site of such wall down to the line
of high-water mark of ordinary tides and the said first-
mentioned lands and other lands in the neighbourhood
thereof could now conveniently be developed in the
interests of the trade of the Port of London :
And whereas by virtue of the Act of 1792 and of
the Act of 1883 the commissioners are entitled to certain
rights or property in the existing river wall and the
old wall:
And whereas the site of the old wall and so much
of the bed and shore of the river Thames as lies between
the line of high-water mark of ordinary tides on the
existing river wall and the site of the old wall are vested
in persons other than the Port Authority :
And whereas by reason of the circumstances aforesaid
development in accordance with the terms of any licences
granted by the Port Authority under the said section 243
of the Act of 1920 to owners and occupiers of the said
lands to execute works in or affecting the river is
hampered and such development is desirable in the
interests of the trade of the Port of London :
And whereas it is expedient that the Port Authority
should be authorised subject to the provisions of this
Act to acquire the site of the old wall and so much of
