A. ANONYMITY OF COMPLAINANTS
Where a complainant makes an allegation of any oence specied under s 2 of the Sexual
Oences (Amendment) Act (SO(A)A) 1992, no matter relating to the complainant during
the complainant’s lifetime should be published if it is likely to lead members of the public to
identify the complainant.1 is is qualied by s 1(4) of the Act and does not extend, for ex-
ample, to a rape complainant who is accused of perjury.2
is includes, specically, the complainant’s name, address, identity of any school or educa-
tion establishment attended by the complainant, the identity of any place of work, and any
still or moving picture of the person.3
In relation to a complainant who is deceased, there is no protection provided by statute. In
a case where the evidence of that complainant is not challenged, with the agreement of de-
fence counsel, the deceased witness could be referred to as Witness A in order to protect his/
her identity. (Such a measure was adopted in R v Delroy Grant (March 2011)— e ‘Night
Stalker’ trial— where the defence was identication.)
1. Oences to which the Anonymity Requirement Applies
1. Rape (under any legislative provision).
2. Burglar y with intent to commit rape (under any legislative provision).
3. Any attempt, conspiracy, incitement, aiding, abetting, counselling, or procuring of
either of the above or any of the oences specied below.
4. Any of the oences below.
