The Pushchairs (Safety) Regulations 1985

Whereas the Secretary of State has, in accordance with section 1(4) of the Consumer Safety Act 1978(a), consulted such organisations as appear to him to be representative of interests substantially affected by these Regulations and such other persons as he considers appropriate:

And whereas the Secretary of State has in accordance with section 1(5) of the Consumer Protection Act 1961(b) consulted with such persons and bodies of persons as appear to him requisite:

And whereas a draft of these Regulations has been approved by a resolution of each House of Parliament pursuant to section 7(7) of the said Act of 1978:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 1 of, and paragraph 14 of Schedule 2 to, the said Act of 1978 and by sections 1 and 2(4) of, and paragraph 3 of the Schedule to, the said Act of 1961, hereby makes the following Regulations:

1. These Regulations may be cited as the Pushchairs (Safety) Regulations 1985 and shall come into operation on 1st June 1986.

2. The Perambulators and Pushchairs (Safety) Regulations 1978(c) shall cease to have effect in so far as they relate to pushchairs.

3.—(1) in these Regulations—

"BS 4792" means the British Standard Specification for safety requirements for pushchairs BS 4792:1984 published by the British Standards Institution on 31st May 1984(d);

"perambulator" means a wheeled vehicle designed for the transport in a seated or recumbent position of one or two babies or infants who are placed inside a body of boat- or box-like shape, but does not include carry-cots or transporters therefor;

"pushchair" means a wheeled vehicle designed for the transport in a seated or reclining position of one or two infants or young children, distinguished from a perambulator by the absence of a body of boat- or box-like shape, but does not include pushchairs designed for use by invalid children.

(2) For the purposes of these Regulations, references in BS 4792 to other British Standard Specifications have the following meanings—

"BS 871" means the British Standard Specification for abrasive papers and cloths BS 871: 1981 published on 30th October 1981;

"BS 1154" means the British Standard Specification for natural rubber compounds (high quality) BS 1154: 1978 published on...
