ALWAYS A 'TRAILER'?

ANinteresting case came on appeal before
the
Recorder
of Coventry Sessions on 17th August 1961.
In
January 1960,
the
appellant,
Ian
George McInnes, set
up his home in a caravan which he placed on Wyken Croft
Caravan Site which was owned and managed by Coventry
Corporation. After about four weeks
the
caravan was moved
against
the
wish of the appellant by
the
servants of
the
Cor-
poration on to
the
grass verge of Wyken Croft Road because
he had kept a dog at
the
caravan contrary to
the
Corporation
rules and had failed to comply with anotice to quit.
On
15th September 196o,
the
Corporation requested
the
removal of
the
caravan from its position on
the
verge and on
the
6th
October 1960,
the
Town
Clerk wrote aletter to
the
appellant giving notice
that
if
the
caravan was not moved by
the
loth
October 1960, steps would be taken to
put
it on
the
highway and stating
that
if
that
was done it might be
that
the
Police would prosecute for obstruction of
the
road if
the
caravan remained thereon for many hours.
On
the
loth
October 1960,
the
caravan still being on
the
verge,
the
Corporation officials towed
the
caravan off
the
verge on to
the
carriageway of Wyken Croft and left it in a
position close to
the
pavement, from which,
up
to the time of
the
hearing of
the
appeal, it had
not
been removed.
Throughout
the
whole of
the
time,
the
caravan had been
the
appellant's home wherein he had lived with his wife and
dog. Furthermore, he intended to continue to use
the
caravan
as his residence unless and until he could obtain a house to live
in.
The
caravan was 7 feet wide and stood on four wheels.
It
was fitted with atowing bar and at any moment could be
moved by attaching
the
tow bar to a suitable vehicle and by
being towed along the road.
