"Proceedings pending or imminent" - Administration of Justice Act, 1960, s. 11 (1).

Section 11 (1) of the Administration of Justice Act, 1960, provides that: "A person shall not be guilty of contempt of court on the ground that he has published any matter calculated to interfere with the course of justice in connection with any proceedings pending or imminent at the time of publication if at the time (having taken all reasonable care) he did not know and had no reason to suspect that the proceedings were pending, or that such proceedings were imminent, as the case may be."Two newspapers having a circulation in Northern Ireland published photographs and other details of a man who was arrested and charged with murder within two days after the publication. At the time of the publication the accused man was under constant police surveillance, and statements to the effect that he was regarded as a principal suspect of the crime were contained in the newspaper reports. On the application of the Attorney-General proceedings were taken requiring four persons, being reporters and local circulation representatives of the two newspapers, to show cause why they should not be committed for contempt of court.
