The Register of Occupational and Personal Pension Schemes (Amendment) Regulations 1997

The Secretary of State for Social Security, in exercise of the powers conferred on her by sections 6(5), 181(1) and 182(2) and (3) of the Pension Schemes Act 19931, and of all other powers enabling her in that behalf, having consulted with such persons as she considered appropriate2, by this instrument, hereby makes the following regulations:–

S-1 Citation, commencement and interpretation

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Register of Occupational and Personal Pension Schemes (Amendment) Regulations 1997 and shall come into force on 29th June 1997.

(2) In these Regulations “the principal Regulations” means the Register of Occupational and Personal Pension Schemes Regulations 19973.

S-2 Amendment of the principal Regulations

2.—(1) The principal Regulations shall be amended in accordance with the following provisions of this regulation.

(2) In regulation 4 (information required in respect of a registrable scheme) in sub-paragraph (b) of paragraph (1) for the words from “receipt of a written notice” to “these Regulations,” substitute “Registrar's, on or after the date of the coming into force of these Regulations, sending by post to the trustees a written notice requiring that information to be furnished,”.

(3) In regulation 8 (transitional provisions) in paragraph (3) for the words “by 30th June 1997.” substitute the words “within 3 months of the Registrar’s sending by post to the trustees a written notice requiring that information to be furnished.”.

These Regulations amend the Register of Occupational and Personal Pension Schemes Regulations 1997 (“the principal Regulations”).

Regulation 1 relates to citation, commencement and interpretation.

The effect of regulation 2(2) is that incidental information required by the Registrar under regulation 4(1)(b) of the principal Regulations is to be provided by the trustees within 3 months of the Registrar’s sending to them by post a written notice requesting the information rather than within 3 months of receipt of such notice.
