The Registration of Births, Deaths and Marriages (Fees) Order 1968

The Minister of Health, in exercise of the powers conferred on him by section 5 of and Schedule 3 to the Public Expenditure and Receipts Act 1968(a), and of all other powers enabling him in that behalf, hereby makes the following order:—

Title and commencement

1. This order may be cited as the Registration of Births, Deaths and Marriage (Fees) Order 1968 and shall come into operation on 16th August 1968.

Interpretation

2.—(1) The Interpretation Act 1889(b) shall apply to the interpretation of this order as it applies to the interpretation of an Act of Parliament.

(2) In this order, any reference to a provision of the Marriage Act 1949(c) specifying sums shall be construed as a reference to that provision as amended by section 23 of and schedule 1 to the Registration Service Act 1953(d) (which increased certain sums specified in the Marriage Act 1949 by 50 per cent.)

Variation of fees, etc.

3. The enactments specified in column 2 of schedule 1 to this order (which relate to the fees, etc., payable in respect of the matters mentioned in column 3 of that schedule) shall be amended by substituting for the sums specified in column 4 of that schedule the sums specified in column 5 thereof.

Fees ceasing to be payable, and repeal of superseded enactments

4.—(1) The sums payable under the enactments specified in column 2 of schedule 2 to this order (which relate to the fees, etc., payable in respect of the matters mentioned in column 3 of that schedule) shall cease to be payable; and the said enactments shall be repealed to the extent specified in column 4 of that schedule.

(2) The fee payable for the issue of a certificate for marriage under section 32(5) of the Marriage Act 1949 (which specifies the fees for issue of a certificate and licence for marriage) shall cease to be payable.

Different provision for certain cases

5.—(1) The fee of three shillings and ninepence specified by section 63(1) of the Marriage Act 1949 for every certified copy of an entry in a marriage register book to which that section applies shall be increased—

(a) to five shillings where application for a copy is made—

(i) at the time of registering the marriage or

(ii) to a registrar by whom the book containing the entry is kept, and

(b) to eight shillings in any other case.

(2) The fee of ninepence specified by section 33(1) of the Births and Deaths Registration Act 1953(a) for obtaining a short certificate of birth—

(a) shall cease to be payable for a certificate obtained at the time of registering the birth (or, if more than one such certificate is obtained, the first of them) and

(b) shall be increased to three shillings in any other case.
