Response to Application for Direction for Succession Tenancy on Death

Section 39 of the Agricultural Holdings Act 1986 (Succession on death)

This is the form to complete if you wish to respond to a Notice of Application for succession to a tenancy on the death of the tenant under section 39 of the Agricultural Holdings Act 1986 (“the Act”).

Your response must be received by the tribunal within 28 days of receiving notice of the application. A landlord who fails to deliver a response cannot participate in the proceedings except to give his or her views on the suitability of the applicant and to apply for consent to the operation of a Case G notice to quit.

Your Response and any accompanying documents must be delivered to the tribunal office by post or hand delivery. You should also include an additional copy of your Response and any accompanying documents for the use of the tribunal. Emailed and faxed copies will not be accepted without prior arrangement with the tribunal and must be followed by hard copies by post or hand delivery. You must also send copies of your Response and any accompanying documents by post or hand delivery to the applicant, any other respondent(s) and any other interested person(s).
