In October 2022, the UK Supreme Court
heard arguments on the competence
of the Scottish Parliament to adopt a
second Independence Referendum
Act. The outcome of the Supreme Court
case is predicted to take many months to
be decided, but the arguments are being
heard against a backdrop of increasing calls
for a second vote on Scotland leaving the
United Kingdom.

With the UK Supreme Court set to rule on whether the Scottish
Parliament can hold a second independence referendum, Sionaidh
Douglas-Scott examines the arguments and finds that, whatever the
legal decision, the issue of Scottish independenc e is not going away.
when the proposition ‘Should Scotland be
an independent country?’ was rejected by
a margin of 10.6 per cent. During the 2014
campaign, the pro-UK, ‘Better Together’
side notably suggested that the only
way Scotland’s EU membership would
be assured was by remaining in the UK.
Thus, in voting against independence,
many Scots might have thought they
were securing EU membership. This
proved not to be the case when the UK
voted for Brexit in 2016 – although 62 per
cent of Scots voted to remain. While the
