In an action of debt upon a bond the defendant pleaded, that the bond was made in another county than where it is alledged in the declaration ; and prayed that the 892 TRIN. 22 CAR. BANCO REGIS ALBTO. IS. attorney might be examined thereupon by force of the statute of 6 E. 2. cap. 2. And the plaintiff demurred, as if it had been a plea in bar to the action : and the defendant joyned in demurrer, and concluded quod ab actione praBcludatur.
