The Smoke Control Areas (Authorised Fuels) (Scotland) Regulations 1986

The Secretary of State, in exercise of the powers conferred on him by sections 33(1) and 34(1) of the Clean Air Act 1956(a), and of all other powers enabling him in that behalf, hereby makes the following regulations:-

Citation and commencement

1. These regulations may be cited as the Smoke Control Areas (Authorised Fuels) (Scotland) Regulations 1986 and shall come into operation on 25th June 1986.

Authorised fuels for the purposes of the Clean Air Act 1956

2. In Scotland the following fuel is hereby declared to be an authorised fuel for the purposes of the Clean Air Act 1956:-

"Geocite", manufactured by Geocite Limited which -

(i) comprises anthracite (as to approximately 68 per cent by weight), petroleum coke (as to approximately 28 per cent by weight) and a starch and resin binder (as to approximately 4 per cent by weight), and

(ii) has an overall sulphur content of less than 2 per cent, by weight.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

Section 11 of the Clean Air Act 1956 makes it an offence to emit smoke from a chimney of a building within a smoke control area unless it can be shown that the emission of smoke was not caused by the use of any fuel other than an authorised fuel. These regulations add the fuel known as "Geocite" to the list of fuels...
