The Spain (Extradition) (Dependent Territories) Order 1991

The Queen's Most Excellent Majesty in Council

Whereas a Treaty was concluded on 22nd July 1985 between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Kingdom of Spain for the extradition of fugitive criminals, the terms of which are set out in the Schedule to the Spain (Extradition) Order 1986 ( a) :

And whereas the said Treaty was ratified on 24th March 1986:

And whereas in accordance with Article 21(1)(a)(ii) of the said Treaty it has been agreed by two Exchanges of Notes both dated 1st February 1991, the terms of which are set out in Schedules 1 and 2 to this Order respectively, that the application of the said Treaty should be extended to those territories for the international relations of which the United Kingdom is responsible and which are set out in Schedules 3A and 3B to this Order:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by sections 2 and 21 of the Extradition Act 1870 ( b) and by section 37(3) of the Extradition Act 1989 ( c) or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the Spain (Extradition) (Dependent Territories) Order 1991 and shall come into force for the territories specified in Schedules 3A and 3B to this Order, respectively, on the date of the entry into force of the corresponding Exchange of Notes covering the territory or territories in question, to be notified in the London, Edinburgh and Belfast Gazettes.

2. Article 3 of the Spain (Extradition) Order 1986 is hereby revoked.

Your Excellency

I have the honour to refer to the Extradition Treaty between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Kingdom of Spain signed at London on 22 July 1985 and to propose that, in accordance with the provisions of Article 21(1)(a)(ii), the Treaty shall extend to the territories listed in the Annex to this Note for the international relations of which the United Kingdom is responsible.

If the foregoing proposal is acceptable to the Government of the Kingdom of Spain, I have the honour to propose that this Note together with Your Excellency's reply in that sense shall constitute an Agreement between our two Governments, which shall enter into force on the date on which each of our two Governments has notified the other of the completion of its internal procedures to give effect to it.

I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.
