The State Immunity (Federal States) Order 1993

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 14(5) of the State Immunity Act 1978 ( a), or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the State Immunity (Federal States) Order 1993 and shall come into force on 7th December 1993.

2. The provisions of Part I of the State Immunity Act 1978 shall apply to the following constituent territories of the Federal Republic of Germany as they apply to a State: Baden-Wu rttemberg, Bavaria, Berlin, Brandenburg, Bremen, Hamburg, Hesse, Mecklenburg-Western Pomerania, Lower Saxony, North-Rhine/Westphalia, Rhineland- Palatinate, Saarland, Saxony, Saxony-Anhalt, Schleswig-Holstein and Thuringia.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order applies the provisions of Part I of the State Immunity Act 1978 to the constituent territories of the Federal Republic of Germany. The Federal Republic of Germany has made a declaration in accordance with paragraph 2 of Article 28 of the European Convention on State Immunity (Cmnd. 7742) to the effect that its constituent territories may invoke the provisions of that Convention applicable to Contracting States and have the same obligations.
