Stevens versus Holmes in Quare Impedit, Le Plaintiff declare que Greenwood fuit seisie del Manner, a quel cest Advowson fuit appendant, & levy un fine de ceo al use deluy mesme pur vie, remainder al son fits Richard pur vie, le remainder al feme de Richard, ove divers Remainders ouster; le Remainder al ses heirs : Et que le tenant par vie & Richard grant le prochien avoydance al Plaintiff. Le Incumbent plead que il est Parson Impersonee, del presentacon del Roy; Et confesse le matter devant: Mes dit, que Greenwood tient cest Manner per redditum, 8s. Id. ib. ad Wardum Castri de Dover, &c. Et un diem clausit extremum issue, que trove accordant, quorum pretextu jus & titulum omniii terrarum, & tenementorum apperteigne al Roy, &c. per que un charge fuit impose sur le terte, pro non prosecutione liberationis: Et cest Mannor fuit extend, per que le presentacon pertein al Roy ; sur que le Plaintiff demurre : Et le sole question in ley fuit, ou ceo fuit Tenure in Chivalry, ou en Socage en Capite : Et per consequence ou le charge fuit bien impose 1 &c. Crawley. Est Socage en Capite, come Littleton 121. que est de pluis validity que F. N. B. 256. a. que est collection solement sur un Breve; & coment que terre tenua del Castle ou honour ab antiquo, ou parcel de Corone, poet ee tenus in Chivalry in Capite, uncore pur ceo que le tenure est mention icy, en pleading, que doet ee prise pluis fortment vers celuy que pleade, ceo serra intend pluis favorablement pur le subject. [48] Mes auterment in un reservacon per Letters Patents, ou le melieux conatruccon serra prise pur le Roy, Et auxi le barre est male; Car est dit quod omnium terrarum, & tenementorum, &c. ou le Roy ne poet aver forsque le 3 part, & cest charge impose est sans ground. Car apres office trove le terre est seisie in possession del Roy, per quel il avoit le terre mesme, & donque il ne poet impose un charge. Athowe e contra.
