The Superannuation (Application of the Superannuation Act 1972, Section 1) Order 1999

The Minister for the Civil Service, in exercise of the powers conferred by section 1(5), (7) and (8)(a) of the Superannuation Act 19721and now vested in him2, hereby makes the following Order:–

S-1 This Order may be cited as the Superannuation (Application of...

1.—(1) This Order may be cited as the Superannuation (Application of the Superannuation Act 1972, Section 1) Order 1999 and, subject to article 2, shall come into force on 23rd March 1999.

(2) In this Order “the Act” means the Superannuation Act 1972.

S-2 With effect from 1st September 1998: section 1 of the Act ...

2. With effect from 1st September 1998:

(a) section 1 of the Act shall apply to employment by the New Opportunities Fund, being employment remunerated out of the National Lottery Distribution Fund; and

(b) employment by the New Opportunities Fund is added to the employments listed in Schedule 1 to the Act.

Section 1 of the Superannuation Act 1972 (under which the Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme and the Civil Service Compensation Scheme have been made) applies to employment and offices listed in Schedule 1 to that Act. This Order adds employment by the New Opportunities Fund and employment by the Data Protection Registrar to those listed in that Schedule.

The New Opportunities Fund (“NOF”) is a body corporate established by section 43A of the National Lottery etc. Act 1993 (c. 39). Section 43A was added by section 7 of the National Lottery Act 1998 (c. 22). The NOF’s powers to appoint staff and to pay pensions are in Schedule 6A to the National Lottery etc. Act 1993, inserted by section 7 of, and Schedule 2 to, the National Lottery Act 1998. The National Lottery Distribution Fund, from which employment in the NOF is remunerated, was established by section 21 of the National Lottery etc. Act 1993.
