The Welsh Ministers, as traffic authority for the A458 Shrewsbury to Dolgellau Trunk Road, in exercise of the powers conferred upon them by sections 1(1), 2(1) and (2) and 4(2) of the Road Traffic Regulation Act 1984( 1) and after consultation with the Chief Officer of Dyfed Powys Police, make this Order.

Title, Interpretation and Commencement

1. This Order comes into force on 30 October 2017 and its title is The A458 Trunk Road (High Street, Welshpool, Powys) (Prohibition of Waiting, Loading and Unloading) Order 2017.

2. In this Order:

“the trunk road”(“y gefnffordd”) means the A458 Shrewsbury to Dolgellau trunk road, High Street, Welshpool in the County of Powys.

Prohibition of Waiting, Loading and Unloading at Any Time

3. Except as provided in article 4, no person shall cause or permit any vehicle to wait, load or unload on the sides of the trunk road described in the Schedule at any time.

Exemptions

4. Nothing in article 3 shall render it unlawful to cause or permit any vehicle to wait on the sides of the trunk road for so long as may be necessary to enable:

(a) a vehicle, if it cannot conveniently be used for such purpose in any other length of road, to be used in connection with any of the following operations:

(i) building, industrial or demolition operations;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of the trunk road; or

(iv) the laying, erection, alteration, or repair in, or in land adjacent to, the said lengths of trunk road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or any electronic communications apparatus as defined in the Telecommunications Act 1984( 2);

(b) a vehicle to be used in the service of a local authority or a water authority in pursuance of statutory functions;

(c) a vehicle to take petrol, oil, water or air from any garage situated on or adjacent to the trunk road;

(d) a vehicle to be used for fire brigade, ambulance or police purposes; or

(e) a vehicle to stop when the person in control of it:

(i) is required by law to stop; or

(ii) is obliged to stop in order to avoid an accident; or

(iii) is prevented from proceeding; or

(iv) is acting upon the direction, or with the permission, of a police...
