The Blackburn with Darwen (Maintained Nursery School Governance) (Amendment) Order 2007

Coming into force 30th March 2007

The Council of the Borough of Blackburn with Darwen acting in its capacity as a local education authority (“the authority”) has, in accordance with section 4(2) of the Education Act 20021(“the Act”), consulted such persons as appear to them to be appropriate;

It is the opinion of the Secretary of State, having regard to the matters set out in section 1(2) of the Act, that the extension of the period for which the Blackburn with Darwen (Maintained Nursery School Governance) Order 20042has effect and the other provisions contained in this Order, may contribute to the raising of educational standards achieved by children in England;

In exercise of the powers conferred upon the Secretary of State by sections 2(1) and 3(1)3of the Act, the Secretary of State for Education and Skills, on the application of the authority, makes the following Order:

1. This Order may be cited as the Blackburn with Darwen (Maintained Nursery School Governance) (Amendment) Order 2007 and comes into force on 30th March 2007.

S-2 Article 3 of the Blackburn with Darwen (Maintained Nursery...

2. Article 3 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004 is amended as follows:

(a) for Article 3(b) substitute:

“(b)

“(b) sections 7(b) and 13(2) of the Education Act 2005 as if after the words “in the case of a maintained school” the words “other than a maintained nursery school” were added.”

(b) after Article 3(d) insert a new sub-paragraph:

“(dd)

“(dd) On and after the date section 88 of the Education and Inspections Act 2006 comes into force, section 88(5) of that Act (responsibility of governing body for discipline) as if paragraph (c) of that subsection were omitted.”

(c) omit Article 3(l) and (m).

3. In Article 5 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004, for “30th March 2007” substitute “30th March 2009”.
