The Building (Amendment) Regulations 2017

Coming into force in accordance with regulation 1(3)
The Secretary of State makes the following Regulations in exercise of the powers conferred by section 1 of and paragraphs 2, 4 and 4A of Schedule 1 to the Building Act 19841.
Citation, application and commencement
1.—(1) These Regulations may be cited as the Building (Amendment) Regulations 2017.
(2) These Regulations do not apply to any building in Wales other than an excepted energy building, and “excepted energy building” has the same meaning as in the Schedule to the Welsh Ministers (Transfer of Functions) (No. 2) Order 20092.

(a) (3) These Regulations come into force on 1st October 2017, except regulation 2(b).
(b)
(b) Regulation 2(b) comes into force on 28th February 2018.
Amendments to the Building Regulations 2010
2. Schedule 3 (self-certification schemes and exemption from requirement to give building notice or deposit full plans) of the Building Regulations 20103is amended in accordance with the following paragraphs—
(a) in column 2, omit “Benchmark Certification Limited,” from paragraphs 4, 8, 9, 12, 13, 14 and 15;
(b) in column 2, for “BM Trada Certification Limited4” in paragraphs 10 and 11 substitute “Assure Certification Ltd”5;
(c) in column 2, omit “,Network VEKA Limited” from paragraphs 10 and 11.

EXPLANATORY NOTE
(This note is not part of the Regulations)
Regulation 2 updates the list of competent person schemes that appear in Schedule 3 to the Building Regulations 2010 ( SI 2010/2214). A competent person scheme is a scheme that installers can register with to self-certify that their building work complies with the Building Regulations 2010.
No impact assessment has been produced for these Regulations as no impact, or minimal impact, on the public, private, or voluntary sectors is foreseen.
