The Civil Courts (Amendment) Order 2013

Made 25th February 2013

Laid before Parliament 4th March 2013

Coming into force 25th March 2013

The Lord Chancellor makes the following Order in exercise of powers conferred by section 2(1) of the County Courts Act 19841, section 33(1) of the Matrimonial and Family Proceedings Act 19842, sections 117 and 374 of the Insolvency Act 19863, section 1156(3) of the Companies Act 20064and section 1156 of that Act as applied and modified by regulations made under sections 15 and 17 of the Limited Liability Partnerships Act 20005.

In accordance with section 2(1) of the County Courts Act 1984 the Lord Chancellor has consulted the Lord Chief Justice before making this Order.

In accordance with section 33(1) of the Matrimonial and Family Proceedings Act 1984, sections 117 and 374 of the Insolvency Act 1986, section 1156(3) of the Companies Act 2006 and section 1156 of the Companies Act 2006 as applied and modified by regulations made under sections 15 and 17 of the Limited Liability Partnerships Act 2000, the Lord Chief Justice concurs in the making of this Order.

1. This Order may be cited as the Civil Courts (Amendment) Order 2013 and shall come into force on 25th March 2013.

2. A county court shall be held at Chippenham and named the Chippenham and Trowbridge County Court.

3. For the purposes of section 33(1) of the Matrimonial and Family Proceedings Act 1984 the Chippenham and Trowbridge County Court shall be a divorce county court and a court of trial.

4. The holding of Burton-on-Trent County Court and Trowbridge County Court is discontinued.

5. The county courts listed in Table 1 in the column headed ‘receiving court’ shall have jurisdiction in proceedings pending at the county court in the column headed ‘closing court’ before this Order comes into force in accordance with directions made under section 2 of the County Courts Act 1984.

7.—(1) The Civil Courts Order 19836is amended as follows.

(2) In Schedule 1, omit—

(a) “Burton- on-Trent” from its position in the second column opposite the entry for “Derby” in the first column;
