The Civil Procedure Act 1997 (Amendment) Order 2006

Coming into force 1st September 2006

The Lord Chancellor makes the following Order in exercise of the powers conferred upon him by section 2A(1) of the Civil Procedure Act 19971, after consulting in accordance with section 2A(2A) of that Act, and with the concurrence of the Lord Chief Justice in accordance with section 2A(2) of that Act.

1. This Order may be cited as the Civil Procedure Act 1997 (Amendment) Order 2006, and shall come into force on 1st September 2006.

2. In section 2 of the Civil Procedure Act 1997 (Rule Committee), in subsection (2)(c), for “one district judge” substitute “either one or two district judges”.

This Order amends section 2 of the Civil Procedure Act 1997 so that the Lord Chief Justice may appoint either one or two district judges to the Civil Procedure Rule Committee


(1) 1997 c. 12. Section 2A was inserted by the Courts Act 2003 (c. 39), s 84 and amended by the Constitutional Reform Act 2005 (c. 4), Schedule 1 paragraphs 261, 263 and 264.
