The Companies (Disclosure of Information) (Specified Persons) Order 2016

Coming into force 1st October 2016
The Secretary of State makes the following Order in exercise of the powers conferred by section 449(3) of the Companies Act 19851.
Citation and commencement
1. This Order may be cited as the Companies (Disclosure of Information) (Specified Persons) Order 2016 and comes into force on 1st October 2016.
Addition of specified persons to Schedule 15C to the Companies Act 1985
2. Schedule 15C (specified persons) to the Companies Act 19852is amended as follows—
(a) after paragraph 3 insert—
“3A. The Commissioners for Her Majesty’s Revenue and Customs.”
(b) after paragraph 6 insert—
“6A. The Director of the Serious Fraud Office.”
(c) after paragraph 7B insert—
“7C. The registrar of companies.
7D. The Gangmasters and Labour Abuse Authority.”.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends Schedule 15C to the Companies Act 1985.
Part XIV of the Companies Act 1985 empowers the Secretary of State to appoint inspectors to investigate the affairs of a company and makes provisions relating to the conduct of investigations.
Section 449 of the Companies Act 1985 makes provision for the security of certain information obtained during the course of such investigations. Schedule 15C contains a list of specified persons to whom information may be disclosed. This Order adds persons to that list.
An impact assessment has not been prepared in relation to this Order as minimal or no impact on the private or voluntary sectors is foreseen.
