The Criminal Justice and Police Act 2001 (Amendment) Order 2014

The Secretary of State makes this Order in exercise of the powers conferred by section 1(2) of the Criminal Justice and Police Act 2001( 1).

A draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament in accordance with section 10A(3)( 2) of that Act.

Citation and commencement

1. (1) This Order may be cited as the Criminal Justice and Police Act 2001 (Amendment) Order 2014.

(2) This Order shall come into force on the twenty eighth day after the day it is made.

Amendment of section 1(1) of the Criminal Justice and Police Act 2001

2. In the Table in section 1(1) of the Criminal Justice and Police Act 2001( 3), after the entry relating to section 5(2) of the Misuse of Drugs Act 1971( 4) insert-

"Section 5(2) of the Misuse of Drugs Act 1971 so far as relating to the following-

(a) khat (within the meaning given by Part 4 of Schedule 2 to that Act), or

(b) any preparation or other product containing khat.

Possession of khat or any preparation or other product containing khat"

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Table in section 1(1) of the Criminal Justice and Police Act 2001 (c. 16)to add possession of khat and any preparation or other product containing khat as a further offence in respect of which a penalty notice may be given.

(1) 2001 c. 16.

(2) Section 10A was inserted in the Criminal Justice and Police Act 2001 by paragraph 11 of Schedule 23 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012.

(3) The Table in section 1(1) was amended by S.I. 2002/1934, S.I. 2004/2540, S.I. 2005/1090, S.I. 2005/3048, S.I. 2009/110and S.I. 2012/1430. It was also amended by paragraph 120 of Schedule 6 to the Licensing Act 2003 (c. 17), paragraph 169 of Schedule 17 and paragraph 1 of Schedule 19 to the Communications Act 2003 (c. 21), paragraph 97 of Schedule 1 to the Fire and Rescue Services Act 2004 (c. 21)and paragraph 2 of Schedule 23 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (c. 10).
