The Secretary of State, in exercise of the powers conferred by sections 139(1)(b) and 207 of the Equality Act 20101, makes the following Regulations:

1. These Regulations may be cited as the Employment Tribunals (Interest on Awards in Discrimination Cases) (Amendment) Regulations 2013 and shall come into force on 29th July 2013.

2. In regulation 3 of the Employment Tribunals (Interest on Awards in Discrimination Cases) Regulations 19962omit paragraph (2) and insert—

“2 Subject to paragraph (3), the rate of interest to be applied shall be, in England and Wales, the rate fixed, for the time being, by section 17 of the Judgments Act 18383and, in Scotland, the rate fixed, for the time being, by section 9 of the Sheriff Courts (Scotland) Extracts Act 18924.”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Employment Tribunals (Interest on Awards in Discrimination Cases) Regulations 1996.

These regulations amend the legislative reference on interest in England and Wales, so that the rate is the same as that in Scotland (currently 8%), and also correct the reference to Scottish legislation on interest. These regulations also make a consequential repeal of regulation 8 of the Employment Tribunals (Interest) Order 1990...
