The Human Trafficking and Exploitation (Scotland) Act 2015 (Commencement No. 4) Regulations 2018

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 45(2) and (3) of the Human Trafficking and Exploitation (Scotland) Act 20151and all other powers enabling them to do so.

S-1 Citation and commencement

Citation and commencement

1. These Regulations may be cited as the Human Trafficking and Exploitation (Scotland) Act 2015 (Commencement No. 4) Regulations 2018 and come into force on 31st January 2018.

S-2 Appointed days

Appointed days

2. The following days are appointed for the coming into force, for all remaining purposes, of the following provisions in the Human Trafficking and Exploitation (Scotland) Act 2015

(a) 31st January 2018 for section 12 (presumption of age of child victim); and

(b) 1st April 2018 for section 9 (support and assistance for adult victims of human trafficking).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force, for all remaining purposes, sections 9 and 12 of the Human Trafficking and Exploitation (Scotland) Act 2015 (“the Act”). Sections 9 and 12 were previously commenced only for the purpose of making regulations.

The Bill for the Act received Royal Assent on 4th November 2015. Section 45(1) brought into force sections 40, 41, 42, 44, 45 and 46 on the day after Royal Assent.
