The Immigration (Isle of Man) (Amendment) Order 2019

Her Majesty, in exercise of the powers conferred by section 36 of the Immigration Act 19711, section 12(5) of the Immigration Act 19882, section 170(7) of the Immigration and Asylum Act 19993, section 163(4) of the Nationality, Immigration and Asylum Act 20024, section 49(3) of the Asylum and Immigration (Treatment of Claimants) Act 20045, section 63(3) and (3A)6of the Immigration, Asylum and Nationality Act 20067, section 60(4) of the UK Borders Act 20078, section 76(6) of the Immigration Act 20149, section 95(5) and (6) of the Immigration Act 201610, section 214(6) of the Data Protection Act 201811, and section 63(3) and (6) of the Sanctions and Anti-Money Laundering Act 201812, is pleased, by and with the advice of Her Privy Council, to order as follows.

S-1 Citation and commencement

1. This Order may be cited as the Immigration (Isle of Man) (Amendment) Order 2019 and comes into force on 14th March 2019.

2. In this Order “the principal Order” means the Immigration (Isle of Man) Order 200813.

3. The principal Order is amended as follows.

S-4 Interpretation — Article 2 amended

4. In article 2—

(a) after the definition of “the 2006 Act”, insert—

““the 2007 Act” means the UK Borders Act 200714;”;

(b) after the definition of “the 2014 Act15, insert—

““the 2016 Act” means the Immigration Act 201616.”.

5.—(1) Article 5 is amended as follows.

(2) In paragraph (b), for “the Interpretation Act 1976 (an Act of Tynwald)” substitute “the Interpretation Act 2015 (an Act of Tynwald)17”.

(3) After paragraph (c) insert—

“(d)

“(d) any reference to “the Minister” is a reference to the Minister for the Cabinet Office18; and

(e)

(e) any reference to a Minister of a named Department is a reference to the Minister of that Department of the Government of the Isle of Man.”.

7. In article 14(2)—

(a) for sub-paragraph (a)(vi) substitute—

8. After Article 21 insert—

Extension of the 2007 Act to the Isle of Man

21A.—(1) The following provisions of the 2007 Act shall extend to the Isle of Man subject to the modifications specified in Schedule 9ZA.

(2) The provisions are—

(a) section 5 (registration regulations);

(b)

(b) section 6 (regulations: supplemental);

(c)

(c) section 7 (effect of non-compliance);

(d)

(d) section 8 (use and retention of biometric information);

(e)

(e) section 9 (penalty);

(f)

(f) section 10 (penalty: objection);

(g)

(g) section 11 (penalty: appeal);

(h)

(h) section 12 (penalty: enforcement);

(i)

(i) section 13 (penalty: code of practice);

(j)

(j) section 14 (penalty: prescribed matters);

(k)

(k) section 15 (interpretation);

(l)

(l) section 61 (citation).”.

9. For article 22(2)21substitute—

22A.—(1) The following provisions of the 2016 Act shall extend to the Isle of Man subject to the modifications specified in Schedule 9B.

(2) The provisions are—

(a)

(a) section 55 (supply of information to the Secretary of State);

(b)

(b) Schedule 9 (persons to whom section 20A of the 1999 Act applies).”.
