The Immigration (Leave to Remain) (Fees) (Amendment No. 2) Regulations 2004

The Secretary of State, in exercise of the powers conferred upon him by sections 5(1) and (3)(b) and 166(3) of the Immigration and Asylum Act 19991, having regard to the meaning of “prescribed” in section 167(1), with the approval of the Treasury, hereby makes the following Regulations:

S-1 These Regulations may be cited as the Immigration (Leave to...

1. These Regulations may be cited as the Immigration (Leave to Remain) (Fees) (Amendment No. 2) Regulations 2004 and shall come into force on 17th December 2004.

S-2 The Immigration (Leave to Remain) (Fees) Regulations 2003 ...

2. The Immigration (Leave to Remain) (Fees) Regulations 20032shall be amended as follows.

S-3 In regulation 2— after the definition of “application”, insert—...

3. In regulation 2—

(a) after the definition of “application”, insert—

““assistance” means assistance, accommodation or maintenance provided under—

(a) section 17, 20 or 23 of the Children Act 19893,

(b) section 22, 25 or 26 of the Children (Scotland) Act 19954, or

(c) Article 18, 21 or 27 of the Children (Northern Ireland) Order 19955;”; and

(b) delete the definition of “immigration employment document”.

S-4 In regulation 5, after paragraph (c) insert— d the application...

4. In regulation 5, after paragraph (c) insert—

“(d)

“(d) the application is made in respect of a person who, at the time of making the application—

(i) is a child under the age of eighteen and is being provided with assistance by a local authority (or, in Northern Ireland, an authority); or

(ii) has limited leave to enter or remain in the United Kingdom which was granted outside the provisions of the immigration rules when he was under the age of eighteen on the rejection of his claim for asylum, and is seeking further leave to remain in the United Kingdom outside the provisions of the immigration rules; or”.
