The Intellectual Property Act 2014 (Commencement No.1) Order 2014

The Secretary of State makes the following Order in exercise of the powers conferred by section 24(1) and (2) of the Intellectual Property Act 2014( 1).

Citation

1. This Order may be cited as the Intellectual Property Act 2014 (Commencement Order No.1) Order 2014.

Interpretation

2. In this Order "the Act" means the Intellectual Property Act 2014.

Commencement

3. The day appointed for the coming into force of section 10(2) of the Act for the purposes of appointing the appointed person under sections 27A(1)(a) and 27B of the Registered Designs Act 1949( 2) is 15th July 2014.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the first commencement order made under the Intellectual Property Act 2014 ("the Act") and brings into force section 10(2) of the Act only to the extent necessary to appoint the appointed person. The appointed person will be able to hear and determine appeals under United Kingdom design law. Section 10(2) of the Act inserts new sections 27A and 27B into the Registered Designs Act 1949. Under new section 27A(1), the Lord Chancellor is responsible for making the appointment of the appointed person. New section 27B sets out the eligibility criteria, as well as the process for appointment and removal of an appointed person.
