The International Organisations (Immunities and Privileges) (Scotland) Revocation Order 2021

This Order is made in exercise of the powers conferred by sections 1(2) and 5(1) of the International Organisations Act 19681and all other powers enabling Her Majesty to do so.

In accordance with section 10(1) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament2.

Accordingly, Her Majesty is pleased, by and with the advice of Her Privy Council, to order as follows:

1. This Order may be cited as the International Organisations (Immunities and Privileges) (Scotland) Revocation Order 2021 and comes into force on the day after the day on which it is made.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the International Organisations (Immunities and Privileges) (Scotland) Order 2009 ( S.S.I. 2009/44) (“the 2009 Order”) to revoke schedule 17. This Order also revokes the International Organisations (Immunities and Privileges) (Scotland) Amendment (No. 2) Order 2017 ( S.S.I. 2017/447) (“the 2017 Order”).

The 2017 Order amended the 2009 Order to confer immunities and privileges, insofar as they are within devolved competence, upon the Unified Patent Court and its representatives, judges, registrars and employees.

On 20 July 2020 the United Kingdom withdrew its ratification of the Agreement on a Unified Patent Court and the Protocol on Privileges and Immunities of the Unified Patent Court done in Brussels on 26 June 2016. This Order therefore revokes the immunities and privileges which were conferred by the 2017 Order.
